General Terms of Sale

These ‘Terms of Sale’ govern access to and use of www.holydayswim.com. The access to and use of this website as well as the purchase of products on www.holydayswim.com, are based on the assumption that you have read, understood and accepted these General Terms of Sale (GTS).

HOLYDAY products (hereafter the “Products”) are exclusively intended to be sold to end consumers, natural persons or end customers legal entities, excluding all resellers or intermediaries acting on behalf of resellers (hereafter the “Customers”). Consequently, the Customer represents that he/she/it is acting as end consumer and that he/she/it has no intention of reselling the Products for commercial purpose.

HOLYDAY can update these General Terms of Sale at any time.

The Customer can become familiar with the GTS in force by clicking on the link https://www.holydayswim.com/legals/termsofsale. The applicable General Terms of Sale at the time of the conclusion of the sales contract are those that are enforceable to, and binding on, the Customer.

Furthermore, with each purchase of Products on the Website, the Customer shall be asked to confirm the acceptance of applicable GTS on the date of placing his/her/its order. Said GTS can be viewed at the time he/she/it is asked to confirm that he/she/it accepts them. To substantiate this acceptance, the Customer must check the box “I have read and hereby accept the General Terms of Sale” on the holydayswim.com website.

Order Terms

Any order placed on www.holydayswim.com shall imply acceptance of the General Terms of Sale and acceptance of the prices and Products available for sale on the Website.

Ordering 

The Customer who wants to place an order must comply with the following procedure:

1. The Customer must select the Product that they would like to order.

2. The Customer checks the content of their basket whilst having the opportunity to delete or modify the quantities of the Products they have selected.

3. The Customer must complete the online order form made available to them and provide the requested information (mandatory information: title, surname, first name and surname, e-mail address, password, delivery address and telephone number for the delivery). The Customer has the option to save this information for later. 

4. The Customer selects and confirms their method of delivery and payment.  

4. The Customer is expected to review the content of their order, the total price, the delivery and invoicing addresses while keeping the possibility of modifying any of the information provided or content of their shopping cart. From this step, the Customer cannot anymore modify and/or cancel their order.

The Customer then receive an e-mail summing up the content of their order, namely:

– The date of the order

– The order number

– The list of Products ordered and their amounts

– Their delivery and invoicing addresses

– The method of delivery (Client’s address)

The Customer is advised to keep this document, which is official proof of their order. The order is then registered and processed by HOLYDAY which checks the availability of the Product(s) ordered. Any order placed implies acceptance of the prices and descriptions of the Products available for sale.

The contract is deemed to have been concluded on the date on which this e-mail is sent.

Order Tracking

A carrier tracking number is provided to the Customer when their order has been confirmed.

If the Customer wants to obtain information concerning the progress of their order, they may log onto the website of the carrier chosen by HOLYDAY that is DHL, at the address www.dhl.com (Speedex for Greece www.speedex.gr) and track their parcel live. 

Product Availability

The offers of Products and prices of HOLYDAY are valid while they are visible on the Website, and subject to stocks availability.

Errors or modifications can exceptionally occur, notably in the event of simultaneous orders of the same Product by several Customers.

In the event the Product is found unavailable after placing the order, HOLYDAY shall inform the Customer by e-mail or by telephone as soon as possible, by suggesting that they either order another Product available on the Website as a replacement, or cancel their order at no cost.

HOLYDAY shall not be held liable in the event of stock shortage or unavailability of Products for orders.

HOLYDAY reserves the right to change at any time and without prior notice the Products offered on the Website.

To ensure a better quality of service and availability of its Products with all of its online Customers, HOLYDAY reserves the right to limit the quantity of Products that can be bought by a given Customer.

Although all efforts are made to ensure that the color and pattern of the Products of which photos are displayed on the Website are true to the original Products, variations may occur, notably due to the technical limitations of color reproduction on the Customer’s computer equipment. Consequently, HOLYDAY cannot be held liable for non-substantial errors or inaccuracies of photographs or graphic representations of Products appearing on the Website.

HOLYDAY reserves the right not to accept an order from a Customer with whom it is in a dispute for a previous order, or if HOLYDAY reasonably considers that this Customer has infringed these GTS or that he/she/it has been engaged in a fraudulent activity, or for any other legitimate reason.

Prices 

The Prices of Products are expressed in Euros with also the possibility to pay in the following currencies Dollar US, Pounds Sterling, Dollar Canadian, Dollar Australian, Yuan, Yen, Won, Rouble Russian (on the basis of a daily conversion via the converter used for the Website) inclusive of taxes and excluding customs duties. For orders outside of the EU the custom duties shall be borne by the Customer. Outside of the cases of reimbursement made (i) in connection with exercising the right of withdrawal or for (ii) lack of conformity and hidden defects, HOLYDAY shall not reimburse the VAT applied to purchases made on the Website (even in the event the Customer, after receipt of the Products, reships the Products for a third country outside of the European Union). HOLYDAY reserves the right to change at any time and without prior notice the prices of Products offered on the Website. The Products are invoiced on the basis of prices displayed on the Website at the time when the order is placed, subject to availability of the Products. All the orders are payable in Euros and must be settled immediately upon placing the order with the exception. In the event of unavailability of certain Products ordered (see Article 4 “Product availability”), only the price and shipping costs related to the available Products shall be debited.

Payment Methods

Credit or Debit Card

HOLYDAY does not process or store any credit card information. All credit card transactions are performed in PIRAEUS BANK’s secure platform accepting Visa, Mastercard, Maestro, Amex, and Diners. If you click on “Authorize Payment” you are confirming that the card belongs to you.

 

Recognizing the importance of electronic payment security, EveryPay is a licensed Payment Institution by the Bank of Greece (Decision No. 280/3 / 23-7-2018 GG B 3010 / 25-7-2018), and manages securely card payment transactions, in accordance with the regulatory framework of the card transaction security management standard. Everypay is certified in accordance with the PCI DSS compliance standards. All EveryPay services are made through secure connections with 256bit SSL certificates. EveryPay also supports the ability to use the 3D Secure service, an additional security token for VISA & MasterCard. The Payer then has to enter his personal secret code to complete the transaction successfully”

Paypal

HOLYDAY accepts payments from PayPal Accounts and reserves the right to process orders only if shipped to the same address that the verified Paypal account is registered with. PayPal handling charges are not refundable in the case of product returns. 

Cash on Delivery (Available only in Greece)

Paying cash on delivery is free of charge and is available only in Greece for orders up to 500 euros. Payment will be collected at delivery by the driver who will contact you to arrange time of delivery.

Payment Security

To help ensure that your shopping experience is secure and simple HOLYDAY uses Secure Socket Layer (SSL) technology. This encrypts and protects the data you send to us over the internet. If SSL is enabled then you will see a padlock at the top of your browser and you can click on this to find out information about the SSL digital certificate registration.

You will also notice that when you look at the location (URL) field at the top of the browser you will see it begin with ‘https:’ instead of the normal ‘http:’. This means that you are in secure mode.

Ownership

The ordered Products remain the property of HOLYDAY until receipt of full payment of the price. However, the Customer assumes the risk (namely of loss, theft or deterioration) regarding the Products delivered from the time that they are delivered to the address indicated at the time of the order.

Delivery Terms and Conditions

Handling and shipping costs depend on the country and the total amount of the order. They shall be indicated on the invoice.

HOLYDAY cannot be held responsible for any action and/or costs and/or taxes (which fall under the Customer’s responsibility) and/or delays due to customs over which it has no control.

For all the Products, the order is prepared for departure from HOLYDAY’s logistics warehouses within a maximum period of 3 working days (subject to stock availability and except for the special case of Products sold “on pre-order” for which the sheet indicates the specific estimated time of delivery) from confirmation by e-mail of the order. The average period between the placing of an order and its delivery is from 4 to 10 working days. This is an average period based on prior orders.

By exception to the above mentioned time frames, “pre-order” transactions may be subject to shipping periods that might exceed the estimated shipping time. The estimated shipping time for “pre-order” transactions may be as long as 3 to 6 months as of the date of the order, as mentioned in the purchase process.

Exceeding this estimated period may not give rise to any cancellation of the order, reduction in the price paid by the Customer, or to any damages. Customer is further informed that in some special cases (e.g. products marketed on “pre-order”), the periods indicated above can be longer. However, failure to deliver within a period of 30 days from the maximum estimated time of delivery, the Customer shall have the possibility to cancel the said order at no cost. The sums that he/she/it will have paid will then be reimbursed. In cases where it has the capacity to do so, HOLYDAY reserves the possibility to offer the Customer a Product of equivalent quality and price as the initial product. If the order reaches a certain volume HOLYDAY may send it to the Customer in several packages. Generally, all of the parcels are shipped via FEDEX. A delivery note is attached to the parcel. Customer is encouraged to keep it as it will serve as proof of delivery.

The Customer must check the compliance of the Products delivered at the time of the delivery and before signature of the carrier’s delivery note. They must indicate on this delivery note and in the form of handwritten reservations any defect concerning the delivery (damaged Product etc.). This verification is deemed achieved as soon as the Customer, or a person of their choice, has signed the delivery note. No claim regarding the condition of the parcel(s) will be admissible thereafter.

In the event of reservations regarding the delivery, the Customer must also confirm them to the carrier at the latest within 3 working days following receipt of the article(s) and send a copy of this letter to HOLYDAY by e-mail to the address customerservice@holydayswim.com with confirmation by registered letter with acknowledgement of receipt to Customer Service at the following address: HOLYDAY SHOWROOM – 10-12 Kifissias Avenue, Marousi 15125 Athens.

In the event of an incomplete address, incorrect address, inability to place the parcel in the Customer’s letterbox, refusal of the parcel by the recipient, lack of information making it impossible to deliver the Product to the recipient at the appointed time, HOLYDAY cannot be held liable for the complete, final, completion of this delivery. If this lack of information leads to a second presentation to the recipient, HOLYDAY shall be entitled to request that the Customer pay the corresponding fees for this second delivery.

The Customer is subject to the general terms of delivery of the carrier that, in some cases, if they do not submit to them can impact the quality of the delivery.

Accordingly, in the event of absence of the recipient, according to the general terms of delivery of the carrier, the product may be presented again and/or left at an agreed drop-off point and/or in front of the Customer’s home and or in a “sorting – pending” centre of the carrier and/or returned to HOLYDAY who shall in no event be held responsible for any theft of, loss, or damage to the Products in connection with to their delivery and, more generally, the final quality of the delivery.

In the event that it is impossible to deliver and if the product must be returned to HOLYDAY by the carrier, HOLYDAY will not make any new delivery.

Returns & Exchanges

Our web store returns policy means that if the customer is not fully happy with the goods that have received, he/she/it can return them to us within 14 days of receipt, providing they are in original resalable condition. Once returned the customer will be entitled to receive an exchange or a refund, which will not include the cost of the original postage and packaging. We are not able to refund or exchange items that appear to have been worn, washed, or are not in original condition. This does not affect and is in addition to the customer’s statutory rights as a consumer. Please make sure all return packages are sent with designated courier service (FEDEX) as we cannot take responsibility for items damaged or lost in the return transit. Please note – The above information relates only to returns on good purchased through the HOLYDAY website, not of our physical retail store. Please see in-store for such information.

In order to receive the ‘Return Form’ please contact our customer services team at customerservice@holydayswim.com. Following the submittance of the Return Form, HOLYDAY is responsible for organising the pick-up and return of the product to its warehouse. 

If you are exchanging a product and the new item is a lower amount we will refund the difference via your original payment method. Exchanged items will only be dispatched once returned goods have undergone quality checks and are subject to product availability at the time of return.

Refunds

Shipping and handling charges paid on your original shipment are non-refundable, and these will be deducted from the amount returned to you in the event you return one of our products. Please allow 5 working days once HOLYDAY receives your product, to process the return and another 5 working days for banks to clear funds on your account.

Outside the EU, customs duties and sales taxes are non-refundable. However, you may be able to recover these by contacting your local customs bureau directly. 

Exchange of Sale Items

For Sale Items where we can only offer an exchange on goods (not a refund). If the customer does not wish to exchange their purchase, he/she/it will be issued a credit note to the value of the item when he/she/it purchased it, valid for 12 months. If a customer exchanges a sale product and there is a difference in the final balance, he will be issued a credit note which can be redeemed on his next purchase.

Store Credit & Gift Cards

Gift cards and credit notes, both for stores and online are valid for 12 months from the date of issue.

 

Intellectual Property 

All documents, information, texts, graphs, images, photographs or any other content published on www.holydayswim.com Website are the exclusive property of HOLYDAY. Consequently, they may not be reproduced, exploited or used for any purpose whatsoever, without the express authorization of the company.

The Customer acknowledges the intellectual property rights of HOLYDAY and undertakes not to infringe them in any manner. More specifically, the Customer expressly undertakes not to manufacture, sell, provide a licence or market in any manner, directly or through a third party, for its benefit or the benefit of a third party, the Products, imitations or reproductions of the Products or the intellectual property rights pertaining to the Products and trademarks belonging to HOLYDAY.
